Handbook of Neutral Practice™ · 2027

Judgment disciplined by method.

Neutrality is not the absence of judgment. It is judgment disciplined by independence, method, evidence and professional responsibility. The Handbook codifies that discipline in ten Parts and 135 chapters, including the nineteen working records of the Neutral’s Practice Desk™.

§ 01Governing principle

What the Handbook does, and where it stops.

The discipline

A professional method, codified.

Mandate, independence, evidence, process, analysis, reporting, digital practice, cross-border work and institutional standing.

The boundary

It does not erase the law or another profession.

Where competence or authority ends, the Neutral must stop, qualify or obtain the correct specialist input.

The 2027 Institutional Edition supersedes earlier certification architecture. Neutral Practice™, Independent Neutral Evaluation™, Certified Neutral™ and Annual Certified Neutrals Bench™ are controlled institutional terms.

§ 03Neutral Practice Lifecycle

From first enquiry to final professional record.

01

Enquiry & suitability

Identify the requested function, urgency, participants, conflicts and whether a neutral process is appropriate.

02

Mandate & design

Define authority, questions, exclusions, communications, timetable, confidentiality and specialist dependencies.

03

Information & evidence

Receive, preserve, index, classify and test material before assigning weight.

04

Participation & process

Interviews, meetings and separate communications under visible fairness and independence controls.

05

Analysis & judgment

Test competing explanations, causation, uncertainty and risk; keep fact and inference apart.

06

Reporting

Reasons with calibrated findings and conclusions; recommendations only within mandate.

07

Issuance & closure

Controlled delivery, clarification, correction, version history, retention and the end of authority.

08

Professional standing

Competence, accurate designation, complaints records and current annual status.

The Neutral Practice Lifecycle, from the Handbook of Neutral Practice™. The same eight stages govern a two-day Snapshot and a six-week panel; only the depth changes.

§ 04Neutral Practice Compass

Five questions organise the discipline.

Across different neutral functions the method may change. The compass does not.

Q1

Mandate

What authority has been entrusted, by whom, for what purpose and with what limits?

Q2

Independence

Can the function be exercised without improper influence, undisclosed conflict or role contamination?

Q3

Competence

Does the Neutral have the professional, sector, jurisdictional and procedural capability required?

Q4

Fair process

Are participation, information, voice and communication handled consistently with the mandate?

Q5

Accountable judgment

Can the Neutral explain the basis, limits and reasoning behind the conclusion?

§ 05Role taxonomy

Neutrality describes how a function is exercised, not one procedure.

Do not treat “neutral” as a synonym for “non-adjudicatory”. Binding effect depends on the mandate and governing framework, not on neutrality itself.

The same matter may contain more than one function. The obligation is to identify the current role, not rely on a historical label (NP 1.3–1.5).

§ 06Before substantive work begins

The twelve-question readiness test.

No.Professional check
01Do I know the exact function I am being asked to perform?
02Do I know the source of authority and who can change it?
03Have independence and conflict issues been screened and disclosed?
04Is the work within my competence and role boundaries?
05Are the required participants, information and process safeguards identifiable?
06Do I know whether the function is evaluative, facilitative, determinative, review or specialist?
07Is confidentiality understood and properly qualified?
08Are jurisdictional or local-law limits identified?
09Can the work be delivered securely and fairly in the chosen format?
10Is there a record of mandate, scope, communications and material decisions?
11Can I explain how uncertainty will be handled?
12Do I know when I must pause, disclose, re-mandate, recuse or withdraw?
