Most people meet a Neutral at the end of a story: after the letters, the threats, the breakdown. That is the most expensive moment to meet one. The Neutral profession’s greatest value lies earlier.
The prevention ladder
- Design: write Neutral routes into contracts, constitutions and charters while everyone is calm.
- Stand: appoint a Standing Neutral or dispute board for long relationships.
- Listen: create Ombuds channels where concerns can surface early.
- Evaluate: test the difficult question with an independent view.
- Negotiate: mediate while interests still overlap.
- Determine: let an expert decide a defined question.
- Adjudicate: arbitration, where a final and enforceable award is the right tool.
Use the least burdensome appropriate process, with enforceability when it is needed. Much of the value lies in what is settled before positions harden.
Why prevention is rare
Prevention is invisible when it works. Nobody celebrates the dispute that never happened. Budgets are set for crises, not for their absence. And advisers are rewarded for fighting well, not for making fights unnecessary. The Global Pound Conference found that seven in ten delegates saw external lawyers as the main obstacle to change in commercial dispute resolution.

Making prevention measurable
TheNeutralsORG™ works with organisations to measure what prevention saves: issues raised early, days of delay avoided, claims never filed, relationships continued. The Six-Stage INDS™ lifecycle (Investigation, Negotiation, Determination, Settlement, Arbitration and Post-Resolution) gives every engagement a shared map, from first signal to lasting outcome.
